Following the opening of the pre-bankruptcy proceedings for the Studenac chain by the Split Commercial Court on 29 September, the submission of outstanding claims has begun. The submission process began on 7 October, with the final deadline for submissions set for Wednesday, 28 October 2026. The deadline for submitting claims is 21 days, commencing from 7 October.

The submission covers outstanding claims for goods delivered and services rendered up to 29 September 2026. It is irrelevant whether the invoices were due for payment on that date. The court rejects late submissions, so creditors must adhere to the stipulated deadline.

The Financial Agency has published the procedure for submission, along with the required forms and rules that creditors must follow. The submission is made on a prescribed form, accompanied by documentation substantiating the claim. The form used is Form 003 – Claim Submission by Creditors in Pre-bankruptcy Proceedings. The submission and accompanying documentation are submitted in one set, with copies of the documents proving the claim being sufficient. The documentation can be submitted in person or by registered mail.

For the Studenac case, the competent authority is FINA in Split, located at 24b Mažuranić Promenade, 21000 Split. When sending, it is necessary to indicate that this is a pre-bankruptcy procedure. The case number is St-431/2026.

Studenac has urged suppliers who have not yet submitted all invoices for goods delivered and services rendered up to 29 September to do so as soon as possible via the standard channel. The company has opened a special email address for reconciling accounts. However, reconciling accounts with Studenac is not the same as the official submission to FINA. Even if Studenac has confirmed the debt, the creditor must submit the appropriate claim in a timely manner.

No fee is charged for submitting the claim. The potential obligation to pay is determined subsequently, following the court's decision on the established and disputed claims. The fee amounts to two percent of the claimed amount, with a maximum base of 25 euros.

Failure to submit does not automatically mean the claim ceases to exist. A creditor who has not submitted their claim in time does not participate in the process of its verification nor have the right to vote on the restructuring plan. Such a creditor is compensated according to the conditions set for the group to which they belong. The exact date for the payment of outstanding claims is not yet known.

Following the submission, FINA will publish a table of submitted claims, followed by a verification process. Studenac and the trustee will comment on the submitted claims. A restructuring plan is expected, which will propose the method and conditions for creditor repayment. The plan will then undergo the prescribed decision-making process and judicial approval. The submission of a claim does not guarantee immediate payment.
