The court handed down a sentence to the 36-year-old Uzbek national of one year and six months in prison. The sentence relates to a traffic accident that occurred on 20 March last year, in which a life was lost. According to established facts, the driver was operating a cargo vehicle, an Opel Combo, at the time.
The incident occurred on a railway line in the settlement of Prikraje, near Dugo Selo. As the vehicle entered the crossing, it was struck by a train, resulting in the death of the co-driver. According to reports, the victim was a work colleague of the driver, and like him, was of Uzbek origin. This tragic outcome resulted from a collision that occurred in the early afternoon, specifically around 12:35.
During the trial, the driver of the vehicle admitted to the offence. In his defence, he stated that he had limited visibility before entering the railway crossing, primarily due to the strong sun which hindered his view. Although he claimed to have approached the crossing slowly and checked the directions, he stated that he did not notice the signal signs or the obstacle on the tracks, which contributed to the occurrence of the accident.
Given the severity of the offence, the court imposed a strict penalty on the convicted individual, including a ban on driving motor vehicles. This ban lasts for four years, with the court noting in its judgment that the offence was serious and endangered road safety. Although the ban is strict, the court left open the possibility that, in the future, at the request of the convicted individual, the measure could be reviewed. In such a case, it could be determined that the driver no longer poses a risk to road safety by operating a vehicle, which could lead to the lifting of the ban.
